Agreement to Terms

By accessing or using SetScribe ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access our service.

Description of Service

SetScribe is a mobile application and web service that helps sports card collectors catalog, organize, and manage their collections using AI-powered scanning technology. Our service includes:

• • AI-powered sports card identification and scanning
• • Personal collection management and organization
• • Community features including shared checklists and social interactions
• • Data synchronization across devices
• • Collection sharing and privacy controls

User Accounts

Account Creation

• • You must provide accurate and complete information when creating an account
• • You are responsible for maintaining the security of your account credentials
• • You must be at least 13 years old to create an account
• • One person may not maintain more than one account

Account Responsibilities

• • You are responsible for all activities that occur under your account
• • You must notify us immediately of any unauthorized use of your account
• • We reserve the right to suspend or terminate accounts that violate these Terms

Subscriptions and Payments

Our Service includes both free and paid subscription tiers. By purchasing a subscription (a "Purchase"), you agree to the pricing and payment terms as specified at the time of purchase.

Billing and Renewals

• • Subscriptions are billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis, depending on the subscription plan you select.
• • At the end of each Billing Cycle, your subscription will automatically renew under the exact same conditions unless you cancel it or SetScribe cancels it.
• • A valid payment method is required to process the payment for your subscription. For web purchases, we use Stripe. For mobile purchases, payments are handled by the respective platform's app store (Apple App Store or Google Play Store).

Cancellations

• • You may cancel your subscription renewal at any time. To cancel, you must do so through the platform on which you originally subscribed.
• • For mobile subscriptions (iOS/Android), you must cancel through your Apple App Store or Google Play Store account settings.
• • For web subscriptions, you must cancel through your account settings on the SetScribe website.
• • You will continue to have access to the premium features until the end of your current billing period.

Refunds

• • Except when required by law, paid subscription fees are non-refundable.

Fee Changes

• • SetScribe, in its sole discretion and at any time, may modify the subscription fees.
• • Any subscription fee change will become effective at the end of the then-current Billing Cycle. We will provide you with reasonable prior notice of any change in subscription fees to give you an opportunity to terminate your subscription before such change becomes effective.
• • Your continued use of the Service after the subscription fee change comes into effect constitutes your agreement to pay the modified subscription fee amount.

Acceptable Use

You May

• • Use SetScribe to manage your personal sports card collection
• • Share your collection with other users (subject to privacy settings)
• • Participate in community features like checklists and discussions
• • Provide feedback and suggestions for improving our service

You May Not

• • Use our service for any illegal or unauthorized purpose
• • Upload malicious code, viruses, or harmful content
• • Attempt to gain unauthorized access to our systems or other users' accounts
• • Impersonate other users or provide false information
• • Scrape, harvest, or collect user data without permission
• • Use our AI scanning technology for commercial purposes without authorization
• • Share or distribute content that infringes on intellectual property rights
• • Harass, abuse, or harm other users

Content and Intellectual Property

Your Content

• • You retain ownership of content you upload to SetScribe
• • You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display the content solely for the purpose of providing and improving the service.
• • You are responsible for ensuring you have rights to any content you upload
• • We may remove content that violates these Terms or applicable laws

Our Content

• • SetScribe and its original content are protected by intellectual property laws
• • Our AI technology, algorithms, and databases are proprietary
• • You may not copy, modify, or distribute our proprietary technology

AI Card Identification Accuracy

SetScribe uses artificial intelligence technology to identify and analyze sports cards. While we strive for accuracy, you acknowledge and agree that:

• • AI identification results are estimates and may contain errors or inaccuracies
• • Card details, valuations, and market prices provided are for informational purposes only
• • You are solely responsible for verifying all card information independently
• • SetScribe makes no warranties regarding the accuracy of AI-generated card data
• • Pricing information may be outdated or incorrect and should not be relied upon for financial decisions
• • Rare or unusual cards may not be properly identified by our AI systems

Always consult professional grading services, current market data, and expert opinions when making important decisions about your card collection's value or authenticity.

Third-Party Services and Integrations

SetScribe integrates with various third-party services to enhance your experience. Regarding these integrations:

External Services

• • eBay pricing data and market information are provided by third parties
• • Payment processing is handled by Stripe and RevenueCat
• • Cloud storage and authentication services are provided by Firebase and Google
• • We do not control the availability, accuracy, or functionality of third-party services

Third-Party Terms and Liability

• • Your use of integrated services is subject to their respective terms of service and privacy policies
• • SetScribe is not responsible for third-party service outages, data breaches, or policy changes
• • Pricing data, market information, and external content accuracy is not guaranteed
• • We may discontinue third-party integrations at any time without prior notice
• • Issues with third-party services should be directed to the respective service providers

User-Generated Content and Copyright

Content Ownership and Rights

• • You retain ownership of photos and images you upload to SetScribe
• • You warrant that you have the right to upload and share any content you submit
• • You grant SetScribe a license to use your content to provide our services
• • You are responsible for ensuring uploaded content does not infringe on others' rights

Card Images and Intellectual Property

• • Photographs of sports cards you own are generally permissible for personal collection management
• • Card designs, logos, and player likenesses may be subject to third-party intellectual property rights
• • Commercial use of card images or SetScribe's AI technology requires separate authorization
• • We respect intellectual property rights and will respond to valid DMCA takedown notices

DMCA and Content Removal

• • Rights holders may submit takedown requests for infringing content
• • We will investigate and respond to valid copyright claims promptly
• • Users who repeatedly infringe on intellectual property rights may have their accounts terminated
• • Counter-notification procedures are available for disputed takedown requests

Privacy and Data

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Community Guidelines

Respectful Interaction

• • Treat all community members with respect and courtesy
• • Keep discussions relevant to sports card collecting
• • Report inappropriate behavior or content to our moderation team

Content Standards

• • Share accurate information about sports cards and collecting
• • Do not post spam, advertisements, or promotional content
• • Respect others' collection data and privacy settings

Service Availability

• • We strive to provide reliable service but cannot guarantee 100% uptime
• • We may temporarily suspend service for maintenance or updates
• • We reserve the right to modify or discontinue features with reasonable notice

Data Loss and System Reliability

While we implement industry-standard backup and recovery procedures to protect your collection data, SetScribe is not responsible for any loss of data that may occur due to:

• • Application crashes, system failures, or technical malfunctions
• • User device failures, operating system issues, or hardware problems
• • Network connectivity issues or internet service interruptions
• • User error, including accidental deletion or modification of data
• • Third-party service outages or failures beyond our control
• • Force majeure events, cyber attacks, or other unforeseen circumstances

We strongly recommend that you regularly export your collection data and maintain your own backups of important card information and images.

Data Storage Hold Harmless

By using SetScribe's data storage services, you acknowledge and agree that:

• • You use our cloud storage and synchronization services at your own risk
• • SetScribe shall not be held liable for any corruption, loss, or unauthorized access to stored data
• • You are solely responsible for maintaining appropriate backups of your collection data
• • Any reliance on our storage systems as your primary or sole data repository is undertaken at your discretion
• • We make no warranties regarding data integrity, availability, or permanence

You agree to hold SetScribe, its affiliates, officers, employees, and service providers harmless from any claims, damages, losses, or expenses arising from data storage issues, including but not limited to data corruption, unauthorized access, service interruptions, or permanent data loss.

Limitation of Liability

SetScribe is provided "as is" without warranties of any kind. We are not liable for:

• • Loss of data or collection information
• • Inaccuracies in AI card identification
• • Service interruptions or technical issues
• • Actions of other users or third parties
• • Any indirect, incidental, or consequential damages

Indemnification

You agree to indemnify and hold SetScribe harmless from any claims, damages, or expenses arising from your use of our service or violation of these Terms.

Termination

By You

You may delete your account at any time through the app settings. Upon deletion, your account and associated data will be removed according to our data retention policies.

By Us

We may suspend or terminate your account if you violate these Terms or engage in harmful behavior. We will provide reasonable notice when possible.

Changes to Terms

We may update these Terms from time to time. Material changes will be communicated through the app or via email. Continued use of SetScribe after changes indicates acceptance of the new Terms.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law provisions.

Dispute Resolution

In the event of any dispute, claim, question, or disagreement arising from or relating to this Agreement or the breach thereof, the parties hereto shall use their best efforts to settle the dispute. If a dispute arises, you agree to first contact us at [email protected].

If the dispute cannot be settled through direct discussions, the parties agree to submit the dispute to binding arbitration. The arbitration shall be conducted in Pennsylvania, and judgment on the arbitration award may be entered in any court having jurisdiction thereof. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction.
